rsyslogd not restarting after upgrade

On my system during an upgrade of rsyslog I get this:

 Setting up rsyslog (5.8.11-3+deb7u2) ...  Stopping enhanced syslogd: rsyslogd already stopped.  Starting enhanced syslogd: rsyslogd Already running.  If you want to run multiple instances, you need to specify different pid files (use -i option) already started.
syslogd cannot be restarted and therefore the ungraded version remains active. I googled and found these bug reports: https://bugs.debian.org/cgi-bin/bugreport.cgi?bug=763700 and https://bugs.debian.org/cgi-bin/bugreport.cgi?bug=763831 ... from which I half understand that some fix must be on the way, but what to do in the meanwhile? I guess a reboot would stop the syslogd, right? How to manually and successfully stop and start this service?
