OK, I've gone through the forum and Google over the past few days and can't resolve this issue I have.
I have a Dell R710 and removed the Perc h7xx and replaced it with a Perc H200. I then flashed the card so that it was in IT mode with bios so that I could boot to a drive if I wanted to.
When installed I chose ext4 and finished off the installation fine. However when I come to try and created a storage pool with zdf I get the error "ZFS is not compatible with disks backed by a hardware RAID controller."
But why? The card is actually not a raid and is in HBA (IT) mode

However when I come to try and created a storage pool with zdf I get the error "ZFS is not compatible with disks backed by a hardware RAID controller."

This is not an error, but a general note that is ever there.
There are no checks in the background, that would only show you this note/warning if it would be applicable; instead it is shown ever.
